IMPORTANT: THIS AGREEMENT CONTAINS BINDING TERMS ABOUT AUTOMATIC RENEWAL, MAIL HANDLING AFTER TERMINATION, LIMITATIONS OF LIABILITY, AND ELECTRONIC COMMUNICATIONS. PLEASE READ IT BEFORE ACCEPTING OR PURCHASING SERVICES.
By checking the acceptance box, signing an order, completing enrollment, paying for a plan, or using a paid Service, the Customer agrees to this Agreement, the applicable order or plan description, the current Fee Schedule, the Privacy Policy, and USPS Form 1583. Website visitors who do not purchase Services are bound only by the provisions governing website and application use.
1. Parties, Scope, and Order of Precedence
This Terms of Service and CMRA Customer Agreement (the "Agreement") is between Business Front, Inc., a Florida corporation ("Business Front," "we," "us," or "our"), and the person or entity that purchases, enrolls in, accesses, or uses the Services ("Customer," "you," or "your").
The "Services" include private mailbox and commercial mail receiving agency services, digital mailbox access, mail imaging, content scanning, forwarding, shredding, pickup, package acceptance, credential-display services, website and mobile-application access, SMS communications, notary services when separately requested, and any other service identified in an order or plan description.
If provisions conflict, controlling federal or state law and applicable USPS regulations govern first, followed by USPS Form 1583, the applicable order or plan description, this Agreement, the Fee Schedule, and then other posted policies. No marketing statement changes this Agreement unless included in a written order signed or electronically accepted by Business Front.
2. Nature of the Mailbox Service
Business Front operates as a Commercial Mail Receiving Agency ("CMRA") registered with the United States Postal Service. Business Front receives U.S. Mail on behalf of authorized addressees and may also accept eligible deliveries from private carriers, subject to this Agreement and operational limits. The Service provides a street mailing address and assigned private mailbox number. It does not create a lease, tenancy, office occupancy, domicile, residency, ownership interest, exclusive possession of space, or other real-property right. Suite B105 identifies Business Front’s physical location and is not the Customer’s suite or mailbox number. Business Front is not the Customer’s registered agent and is not authorized to accept service of process unless Business Front has separately agreed in a written registered-agent agreement and is legally eligible to do so. Receipt of legal or governmental mail does not create a duty to monitor deadlines or provide legal advice.
3. Eligibility, Enrollment, and USPS Form 1583
The Customer must be at least eighteen years old and legally capable of entering this Agreement. A person accepting for an entity represents that the person has authority to bind the entity. Mailbox service will not be activated until Business Front has received, verified, and approved all required information, including a complete and properly signed USPS Form 1583 and acceptable, current primary and secondary identification. The Customer must sign or confirm the Form 1583 signature in the physical or real-time virtual presence of an authorized Business Front representative, or acknowledge the signature before a qualified United States notary, as permitted by USPS rules. Each addressee must be properly authorized. Separate forms may be required for spouses, individuals, trade names, affiliates, officers, employees, or additional businesses. Business Front may withhold access to mail or return unauthorized mail as required by USPS rules when no valid Form 1583 is on file. The Customer must promptly provide updated information and identification whenever any Form 1583 information changes or an identification document expires. Business Front may request reverification at any time required for legal, security, fraud-prevention, or USPS-compliance purposes.
4. Proper Address Format and Permitted Use
The Customer must use the exact address issued by Business Front and must identify the assigned private mailbox by "PMB" or "#" as instructed. The Customer may not substitute "Suite," "Ste.," "Unit," "Apartment," or similar wording for the PMB designation, combine Business Front’s suite number with the Customer’s PMB number, or represent that the Customer occupies Business Front’s premises. The address may be used only for lawful mailing and business purposes approved under the selected plan. It may not be used to mislead any person, evade a court or governmental order, conceal an unlawful enterprise, receive contraband, facilitate fraud, establish false residency, or violate any agreement with a governmental agency. Business Front does not guarantee that a bank, lender, licensing agency, tax authority, marketplace, payment processor, insurer, governmental body, or other third party will accept the address for a particular purpose. The Customer is responsible for confirming third-party requirements before listing the address.
5. Mail Receipt and Digital Mailbox Services
Business Front may record the outside of incoming mail and packages, including sender information, tracking numbers, dimensions, condition, and receipt time, and may upload exterior images to the Customer’s account. Notifications are a convenience only. The Customer remains responsible for monitoring the account and collecting or directing mail promptly. When the Customer requests an open-and-scan service, the Customer authorizes Business Front and its service providers to open the identified item, scan its contents, store and transmit the resulting images, and securely dispose of physical copies only according to the Customer’s instruction and applicable retention rules. Business Front may decline to open items that appear restricted, dangerous, privileged, unusually valuable, damaged, or unsuitable for scanning. Mail-forwarding and remailing require a verified destination address, new postage, and applicable handling charges. Delivery dates are estimates. Business Front is not a carrier and does not control carrier delays, customs, weather, address errors, or delivery failures after tender to a carrier.
6. Mail Pickup and Authorized Recipients
The Customer or a properly authorized recipient may pick up available mail during posted pickup hours or by appointment. Business Front may require current government-issued photo identification, account verification, a signature, and any documentation reasonably necessary to confirm authority. Business Front may refuse release when identity or authority cannot be verified or when release would violate law, sender restrictions, or USPS requirements. The Customer must keep authorized-recipient information current. Business Front may rely on the most recent written authorization in its records but may require new authorization for accountable, restricted-delivery, legal, governmental, or unusually valuable items.
7. Packages, Storage, and Restricted Items
Package acceptance is subject to available space, staffing, carrier practices, and the limits shown in the applicable plan or Fee Schedule. Business Front may refuse private-carrier packages that are oversized, overweight, leaking, damaged, perishable, hazardous, illegal, inadequately packaged, cash-on-delivery, refrigeration-dependent, live, or otherwise unsafe or operationally unreasonable. USPS Mail will be handled as required by USPS regulations. Free storage periods, storage fees, and disposition deadlines are stated in the applicable plan or Fee Schedule. The Customer authorizes Business Front, after required notice and expiration of the applicable period, to return, forward, donate when lawful, recycle, or securely destroy abandoned items, subject to USPS rules and the post-termination provisions below. Business Front does not acquire ownership of an item merely by receiving it. Business Front is not responsible for concealed damage or for the nature, legality, value, or condition of contents. The Customer must not direct shipments of currency, controlled substances, weapons, explosives, dangerous goods, unlawful items, or property requiring special licensing or handling without prior written approval.
8. Credential or License Display Service
If separately purchased, Business Front may display an eligible professional or business credential in a designated common area. The Customer must provide an authentic, current credential and remains solely responsible for licensure, registration, display, inspection, and regulatory compliance. Display does not mean that Business Front employs, supervises, sponsors, endorses, or provides occupied premises to the credential holder. Credential display may be limited to active Business Front mailbox customers or customers of an approved platform provider. Business Front may remove an expired, suspended, altered, misleading, or unauthorized credential, or remove any credential when the related service ends. Fees and display specifications are controlled by the applicable order and Fee Schedule.
9. Notary and Ancillary Services
Notary services, when available, are separate from mailbox service, require the signer’s personal appearance or lawful online process as applicable, satisfactory identification, a complete document, and payment of applicable fees. A notary may refuse an act when identity, willingness, awareness, document completeness, or legality is reasonably in doubt. Business Front and its nonattorney notaries do not select notarial acts, prepare legal documents, or give legal advice.
10. Plans, Fees, Taxes, and Payment Authorization
Plan prices, included quantities, overage charges, setup charges, postage, scanning, forwarding, storage, package, pickup, notary, credential-display, and other fees are disclosed in the order, plan description, or Fee Schedule presented at or before purchase. "Starting at" pricing refers only to the identified base plan. Additional services and usage may incur additional charges. The Customer authorizes Business Front and its payment processor to charge the payment method on file for recurring plan fees, authorized services, postage, storage, overages, taxes, returned-payment charges, and other amounts due under this Agreement. The Customer must maintain valid billing information. Business Front may require a postage or service deposit and may replenish it using the authorized payment method as disclosed at purchase. Except where law requires otherwise, fees are earned when the applicable service period begins or service is performed. Postage, carrier charges, completed scans, notarizations, special handling, and other consumed services are nonrefundable. Business Front will correct duplicate or erroneous charges after reasonable verification.
11. Automatic Renewal and Cancellation
Unless the order states otherwise, mailbox subscriptions renew automatically for successive periods equal to the selected billing period until canceled. Before acceptance, Business Front will disclose the recurring amount or method of calculation, billing frequency, material fees, and cancellation method. The Customer may cancel through any online cancellation method made available in the account or by written notice to virtualoffice@businessfront.space. Cancellation will stop future renewal charges after the current paid period, unless an earlier effective date is required by law. Unless required by law or expressly stated in the plan, cancellation does not create a prorated refund for a period already begun. Canceling billing does not eliminate accrued charges, the duty to stop using the address, the USPS post-termination rules, or charges for remailing, postage, storage, or other post-termination services selected by the Customer.
12. Suspension and Termination
Business Front may suspend account features for nonpayment, failed identity verification, expired identification, suspected compromise, policy violations, or investigation. Suspension does not authorize Business Front to disregard USPS duties. Charges may continue for services that remain active or are required during suspension. Business Front may terminate immediately for fraud, unlawful use, false identity information, threats or abusive conduct, prohibited items, governmental or postal direction, material security risk, or a material breach that cannot reasonably be cured. For a curable payment or nonmaterial breach, Business Front may provide notice and a reasonable opportunity to cure before termination. On termination, the Customer must immediately stop representing the address as current, notify senders directly, and remove the address from websites, marketing, registrations, licenses, accounts, and filings as appropriate. Neither the Customer nor Business Front will file a USPS change-of-address order from the CMRA address upon termination.
13. Closed Mailboxes and Post-Termination Mail Handling
This section is intended to implement USPS Domestic Mail Manual § 508.1.8.4 and will be interpreted consistently with the current USPS rule. If the USPS changes its requirements, the controlling USPS requirement governs.
13.1 Six-Month USPS Period. For at least six months immediately after the termination date, Business Front will not refuse delivery of U.S. Mail solely because the addressee is a former Customer. Business Front will record the termination in its Form 1583 records and the USPS CMRA Customer Registration Database and will retain required records for the period required by USPS.
13.2 Ninety-Day Courtesy Pickup Window. For the first ninety calendar days after termination, U.S. Mail accepted for the former Customer and physically held by Business Front will be available for pickup during posted pickup hours or by appointment. The former Customer or authorized recipient must present satisfactory current identification and sign for the release when requested. A closed account does not prevent a verified former Customer from retrieving mail during this courtesy window. Optional processing, scanning, storage beyond any included period, or forwarding services remain subject to disclosed charges. At the end of day ninety, in-person pickup access ends unless Business Front agrees otherwise in writing. Private-carrier packages are not subject to the USPS six-month remailing rule and may have shorter pickup, storage, return, or disposal periods stated in the Fee Schedule.
13.3 Customer’s Written Post-Termination Instruction. BY ACCEPTING THIS AGREEMENT, THE CUSTOMER INSTRUCTS BUSINESS FRONT NOT TO REMAIL POST-TERMINATION MAIL UNLESS THE CUSTOMER SUBMITS AND FUNDS A SEPARATE WRITTEN REMAILING REQUEST. Under this default instruction, Business Front will accept U.S. Mail as required during the six-month period, make held mail available during the ninety-day courtesy pickup window, and after that window securely shred or otherwise securely dispose of mail received for the former Customer, except when law, a court order, law enforcement, or USPS requires different handling. The Customer may change the default instruction by submitting a written remailing request before termination or during the applicable six-month period. A remailing request must provide a verified remail address or approved email destination for scanned correspondence, authorize applicable handling charges, and fund new postage. Business Front will record the remail address as required by USPS.
13.4 Remailing Election. If the Customer elects remailing, Business Front will remail eligible U.S. Mail for at least the remainder of the six-month period, using new postage. The Customer authorizes charges to the payment method or deposit on file for postage and disclosed handling fees. If payment fails or funds become insufficient, Business Front will notify the Customer using the current contact information. Unless the Customer promptly restores funds, the Customer’s default written "do not remail" instruction above will control future items, to the extent permitted by USPS rules.
13.5 Prohibited Closure Instructions and End of Period. Business Front will not agree to instructions requiring it to refuse mail for a former Customer during the six-month period, return such mail to sender during that period merely because the account is closed, hold mail during that period and later return it to the Post Office, or redeposit mail without new postage. After the six-month period, Business Front may return qualifying U.S. Mail to the responsible Post Office with the endorsement and handling required by USPS. Mail will not be placed in a collection box for return.
14. Customer Responsibilities
The Customer must provide accurate, current information; secure account credentials; monitor the account; maintain authorized recipients; use the correct PMB format; promptly direct or collect mail; pay charges; comply with laws and postal rules; and notify Business Front of suspected unauthorized access, identity misuse, unlawful mail, or misdirected items. The Customer must not access, scan, forward, open, destroy, or direct any item addressed to another person or entity unless legally authorized. If unauthorized mail appears in the Customer’s account, the Customer must notify Business Front and take no other action.
15. Investigations, Legal Process, and Safety
Business Front may cooperate with USPS, the U.S. Postal Inspection Service, law enforcement, courts, regulators, carriers, and other lawful authorities. Business Front may inspect exterior packaging, isolate suspicious items, withhold access, preserve records, or take other actions reasonably necessary for safety, fraud prevention, legal compliance, or protection of customers and staff. Business Front will not knowingly assist unlawful use of a PMB.
16. Privacy, Confidentiality, and Data Security
Business Front’s Privacy Policy explains its collection, use, sharing, retention, security, and disposal of personal information. The Customer acknowledges that identity documents and Form 1583 information may be uploaded to and maintained in USPS systems and made available to postal representatives or inspectors as required by law. Business Front may use service providers for hosting, digital mailbox functions, communications, payments, identity verification, scanning, and support. Business Front will use reasonable administrative, technical, and physical safeguards appropriate to the information it maintains. No system is completely secure. The Customer must protect account credentials and promptly report suspected compromise. Business Front will provide legally required notices of a qualifying security breach and will securely dispose of customer records when no longer required to retain them. The Services are not represented as HIPAA-compliant, and Business Front does not enter a business associate relationship merely by receiving or scanning mail. A Customer subject to special confidentiality, privacy, export-control, financial, health-information, or records laws must obtain prior written confirmation that the requested use is supported.
17. Website, Application, and Account Use
Business Front grants the Customer a limited, revocable, nonexclusive, nontransferable right to use the website and application for the Services. The Customer may not scrape, copy, reverse engineer, probe, disrupt, overload, circumvent security, introduce malicious code, impersonate another user, or use the system to violate law or third-party rights. Account credentials may be used only by the Customer and authorized users within the Customer’s organization. The Customer is responsible for activity performed through its account until Business Front receives notice of compromise and has a reasonable opportunity to act.
18. Third-Party Platforms and Carriers
Certain Services depend on third-party software, communications providers, payment processors, notaries, carriers, and hosting providers. Their separate terms may apply. Business Front is responsible for selecting and overseeing its providers as required by law but does not control independent carrier operations, Internet availability, cellular delivery, customs, or third-party outages.
19. SMS/MMS Communications Terms
19.1 Optional Consent and Program Description. If the Customer affirmatively opts in, Business Front may send SMS or MMS messages to the number provided. SMS consent is optional and is not a condition of purchasing mailbox service. Consent given to Business Front applies only to Business Front and will not be treated as consent for Perfect 10 Nail & Technology School, Inc. or any other company unless the Customer separately and expressly consents to that sender. Messages may include conversational responses, enrollment or identity-verification updates, account and security alerts, appointment reminders, mail or package notifications, pickup notices, payment receipts, billing reminders, service changes, support messages, and, only when separately authorized, promotional messages.
19.2 Frequency and Charges. Message frequency varies based on account activity and Customer requests. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. Business Front does not guarantee that any message will be received by a particular time, and SMS must not be relied upon as the sole notice of legal, tax, regulatory, filing, or response deadlines.
19.3 Opt-Out and Help. The Customer may opt out of Business Front SMS messages at any time by replying STOP. Business Front may send one confirmation message and will honor the request within the time required by law. After opting out, the Customer may still receive communications through email, the application, telephone, or postal mail when permitted. Other reasonable opt-out requests communicated directly to Business Front will be honored as required by law. Opting out of SMS does not cancel mailbox service or recurring billing; cancellation must be completed under Section 11.
19.4 Customer Number and Consent Records. The Customer represents that the Customer is the subscriber or customary user of the number provided and has authority to consent. The Customer must promptly notify Business Front if the number changes, is reassigned, or is no longer controlled by the Customer. Business Front may retain consent, message, opt-out, and support records to document compliance and administer the program.
19.5 Message Practices and Privacy. Business Front will identify itself in program messages as appropriate, will not sell SMS consent, and will not share telephone numbers with third parties for their independent marketing. Numbers may be provided to communications vendors solely to operate the program, maintain security, and comply with law. SMS information is also governed by the Business Front Privacy Policy. Business Front will apply applicable quiet-hour, consent, and revocation requirements to promotional communications.
20. Intellectual Property
Business Front’s names, logos, website, application, text, graphics, software, workflows, and other content are owned by or licensed to Business Front and are protected by applicable law. Except for the limited right to use the Services, no license or ownership right is granted. The Customer may not use Business Front branding in a manner implying sponsorship, partnership, office occupancy, agency, or endorsement without written permission.
21. Service Availability and Disclaimers
Services are provided on an "as available" basis. Business Front does not warrant uninterrupted application access, instantaneous scanning or forwarding, carrier performance, acceptance of the address by third parties, or achievement of any business, licensing, banking, credit, tax, or regulatory result. Business Front will use commercially reasonable efforts to perform the Services described in the selected plan. To the maximum extent permitted by law, Business Front disclaims implied warranties of merchantability and fitness for a particular purpose, except that this disclaimer does not eliminate an express obligation in this Agreement, a nonwaivable statutory duty, or a duty imposed by USPS regulations.
22. Limitation of Liability
To the maximum extent permitted by law, neither party will be liable for consequential, special, exemplary, incidental, or punitive damages, or for lost profits, lost business opportunity, or reputational harm, arising from the Services, even if advised of the possibility. Business Front is not responsible for carrier delay or loss, customs action, sender error, concealed damage, interruption outside its reasonable control, or a Customer’s failure to monitor, collect, direct, or update mail and contact information. Business Front’s aggregate liability for claims arising from the Services will not exceed the greater of two hundred fifty dollars or the fees paid by the Customer to Business Front for the affected Service during the six months preceding the event giving rise to the claim. This limitation does not apply to liability that cannot lawfully be limited, or to Business Front’s fraud, willful misconduct, or gross negligence. To the extent permitted by law, a claim arising from this Agreement must be commenced within one year after the claimant knew or reasonably should have known of the facts giving rise to the claim.
23. Indemnification
The Customer will defend, indemnify, and hold harmless Business Front and its officers, directors, employees, and agents from third-party claims, losses, and reasonable costs arising from the Customer’s unlawful use of the Services, false or unauthorized address representations, prohibited items, infringement, fraud, violation of postal rules, instructions concerning mail, or material breach of this Agreement. This provision does not require indemnification for Business Front’s own gross negligence, willful misconduct, or violation of law.
24. Force Majeure
Neither party is liable for delay caused by events beyond its reasonable control, including severe weather, fire, flood, epidemic, war, civil disturbance, labor disruption, utility or Internet failure, carrier interruption, government order, court order, cyberattack despite reasonable safeguards, or failure of a critical third-party system. Payment obligations for completed services and USPS-imposed mail-handling duties remain subject to applicable law.
25. Electronic Records and Notices
The Customer consents to electronic contracting and to receiving agreements, invoices, notices, disclosures, and records electronically. Business Front may send operational notices to the current email address, account, application, or mailing address on file. The Customer must keep contact information current. Notices to Business Front must be sent to virtualoffice@businessfront.space or the physical address stated above, unless Business Front designates another notice address.
26. Changes to Terms or Services
Business Front may update this Agreement prospectively for legal, security, operational, or service reasons. Material changes will be communicated through the website, account, or current contact information with reasonable advance notice when practicable. A change will not retroactively alter a dispute that arose before its effective date. Continued use after the effective date constitutes acceptance only to the extent permitted by law; Business Front may request affirmative acceptance for material changes.
27. Governing Law and Venue
Florida law governs this Agreement, without regard to conflict-of-law principles, except where federal law controls. Any action arising from this Agreement must be brought in a state court of competent jurisdiction in Duval County, Florida, or in the United States District Court for the Middle District of Florida, Jacksonville Division, as jurisdiction permits. Each party consents to personal jurisdiction and venue in those courts.
28. General Provisions
The parties are independent contractors. This Agreement does not create a partnership, joint venture, franchise, fiduciary relationship, employment relationship, landlord-tenant relationship, or agency other than the limited mail-receiving agency expressly authorized by Form 1583. The Customer may not assign this Agreement without Business Front’s written consent. Business Front may assign it in connection with a merger, reorganization, sale of substantially all relevant assets, or transfer to a successor that assumes the applicable obligations. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain effective. Failure to enforce a provision is not a waiver. Section headings are for convenience. Provisions that by their nature should survive termination — including payment, address-use restrictions, post-termination mail handling, privacy, intellectual property, disclaimers, liability, indemnity, and dispute terms — will survive. This Agreement, the incorporated documents, and the applicable order constitute the entire agreement concerning the Services and replace prior terms on the same subject. A Customer-specific modification must be in a writing accepted by an authorized Business Front representative.
Customer Post-Termination Handling Election
This election is presented as a separate required selection during mailbox enrollment and again when the mailbox is closed. The Customer may update the election in writing, subject to USPS requirements and payment of applicable postage and fees.
OPTION A — REMAIL FOR SIX MONTHS. I request remailing to my verified address or approved email destination. I authorize new postage and disclosed handling charges and will maintain sufficient funds or a valid payment method.
OPTION B — DO NOT REMAIL. I instruct Business Front not to remail post-termination mail. Mail may be picked up during the ninety-day courtesy window. After that window, I authorize secure destruction or disposal, while Business Front continues accepting U.S. Mail for the USPS-required six-month period.
NOTICE: I understand that neither I nor Business Front will file a USPS change-of-address order from the CMRA address when service ends. I must notify senders directly and stop using the address.
